[BESTAO Translation] - AUG 20, 2021, Personal Information Protection Law of the People's Republic of China Issued

On August 20, 2021, Standing Committee of the National People's Congress of China issued the Personal Information Protection Law of the People's Republic of China (hereinafter referred to as “the Protection Law”) and it will come into force on November 1, 2021.


In recent years, the NPC and its Standing Committee have formulated provisions concerning personal information security and protection in multiple laws, including the cybersecurity law, general rules of the civil code, criminal law and e-commerce law. The implementation of this new Protection Law is a sequel action in China for data and information protection, and it is the first law specifically developed to protect personal information in China. 

 

The Protection Law consists of 8 chapters with 73 articles. It clearly defines the scope, rights of individuals to deal with personal information, along with information processor obligations and legal liabilities. It also outlines and clarifies further rules on cross-border provisions for personal information, which we would suggest foreign investors and companies that has relevant activities or request on such information management to closely study and observe the details for compliance purpose.
