[Import - Export] - JUL 8, 2021, GAC Released Interpretation on Notice on the Adjustment of the Catalogue of Import and Export Commodities Subject to Inspection

On June 10, 2021, Notice on the Adjustment of the Catalogue of Import and Export Commodities Subject to Inspection (General Administration of Customs Announcement No.39 [2021]) entered into force. What impact will this have on the vast majority of import and export enterprises?

Customs Advice

(1)

Law of the People's Republic of China on Import and Export Commodity Inspection stipulates that:

No permission shall be granted for the sale or use of import commodities included in the Catalogue until they have undergone inspection;

No permission shall be granted for the export of export commodities included in the Catalog until they have been found to be up to standard through inspection.

When handling the import and export business, import and export trade related parties should timely go through the customs formalities for those newly added to the Catalogue including 8 products with 10-digit HS code involving imported recycled raw materials, and 24 products with 10-digit HS code related to the export of steel billets and pig iron, and allow sufficient time to avoid delay in delivery or acceptance.

It is recommended that import and export trade related parties take the initiative to collect compulsory technical specifications of related products, or consult local competent customs to ensure the compliance of import and export commodities.


Important Reminder

In accordance with Law of the People's Republic of China on Import and Export Commodity Inspection (Article 33): Where a person, in violation of the provisions of this Law, sells or uses the import commodities subject to inspection by the commodity inspection authorities, for the inspection of which he fails to file an application and which have not undergone inspection, or exports the commodities for export subject to inspection by the commodity inspection authorities, for the inspection of which he fails to file an application and which fail to pass the inspection, his unlawful gains derived therefrom shall be confiscated by the commodity inspection authorities and, in addition, be fined not less than five percent but not more than twenty percent of the value of the commodities; and if the violation constitutes a crime, he shall be investigated for criminal responsibility according to law.
