



The national standard GB/T 39550-2020 "E-commerce Platform Intellectual Property Protection Management" was released on November 9, 2020. This standard will contribute to the protection of intellectual property rights (IPR) of e-commerce platforms, under the legal framework of relevant laws and regulations such as the current e-commerce law, the patent law, the Supreme People's Court regarding guiding opinions on the trial of intellectual property civil cases involving e-commerce platforms, taking into consideration the development of China’s e-commerce and the experience gained in IPR protection of e-commerce platforms experience.
The standard covers patent rights, trademark rights, copyrights, geographical indications and other intellectual property rights, aiming at operators of e-commerce platforms, business operating in the platforms, online or offline supervisors, and other relevant parties. It is applicable for the management of information releasing, construction, operation and maintenance of e-commerce platforms. It also provides technical requirements for the operation of e-commerce merchants.
The standard stipulates the management of e-commerce platform, including information management, system regulation, intellectual property dispute resolution, etc.; it stipulates the relevant requirements of e-commerce network information platform, including overall requirements, functional requirements, evidence management, supervision assistance, and new technology applications, etc.; it also stipulates the organization of intellectual property management, including overall requirements, mechanisms and responsibilities, information and knowledge resources.
In addition, this standard also provides conformance testing requirements for e-commerce platform operators, merchants, and information platforms that claim to comply with this standard.
