



On February 28, 2022, the State Administration for Market Regulation (SAMR) issued a draft on the Notice on Special Access Conditions for Qualification Accreditation of Commodity Import and Export Inspection Agencies (hereinafter referred to as “the Notice”) and has called for public comments until March 30, 2022.
It is stated that the Special Access Conditions for Qualification Accreditation of Commodity Import and Export Inspection Agencies (hereinafter referred to as “the Regulation”) was formulated under guidance from the Notice by the State Council Regarding Deepening the Reform of Separating Permits from Business Licenses and Further Increasing the Development Vitality of Market Participants (issued by the State Council on May 19, 2021).
The legal basis of the Regulation include: i) Metrology Law of the People's Republic of China; ii) Law of the People's Republic of China on Import and Export Commodity Inspection; iii) Regulations of the People's Republic of China on Certification and Accreditation; iv) Measures for the Administration of the Accreditation of Inspection and Testing Institutions, most of which were revised or amended after 2020.
