Overview:
1) The Fund for the Disposal of Waste Electrical and Electronic Products is a government-managed fund to promote the recycling and disposal of waste electrical and electronic products, which will be used for subsidizing the recycling and disposal costs of waste electrical and electronic products. Funds may be reduced by adopting design schemes that are conducive to the comprehensive utilization of resources and harmless treatment, as well as electrical and electronic products produced with environmentally friendly and recyclable materials. Producers of electrical and electronic products can be exempted from the fund if they produce electrical and electronic products for export. Producers of electrical and electronic products who import electrical and electronic products and have paid the fund shall be exempted from the fund when selling in China.
2) China implements a qualification licensing system for the disposal of waste electrical and electronic products. Competent ecological and environmental departments of municipal people's governments shall examine and approve the qualifications of waste electrical and electronic products disposal enterprises. Enterprises that have obtained the qualification for the disposal of waste electrical and electronic products may apply for fund subsidies for the disposal of waste electrical and electronic products listed in the disposal Catalogue.
Legal Basis
Regulation on the Administration of the Recovery and Disposal of Waste Electrical and Electronic Products
Article 7 The state shall establish a fund for the disposal of waste electrical and electronic products to provide subsidies for the expenses for recovering and disposing of waste electrical and electronic products. The producers of electrical and electronic products, the consignees of imported electrical and electronic products and their agents shall, according to the relevant provisions, perform their obligation of payment to the fund for the disposal of waste electrical and electronic products.
Article 10 The producers of electrical and electronic products, the consignees of imported electrical and electronic products or their agents shall produce or import electrical and electronic products which conform to the relevant provisions of the state on the pollution control of electrical and electronic products, adopt designing plans favorable to the comprehensive resource utilization and innocuous disposal, and use non-toxic, non-hazardous, lowly toxic or lowly hazardous materials which can be conveniently recycled. Such information as content of relevant toxic or hazardous substances and prompt on recovery and disposal shall be stated on the electrical and electronic products or in the product instructions according to the relevant provisions.
Administrative Measures for Eligibility License for Disposal of Waste and Discarded Electrical and Electronic Products
China shall adopt a centralized disposal system for waste and discarded electrical and electronic products and encourage the large-scale, industrial and professional disposal of waste and discarded electrical and electronic products. (These Measures shall apply to applications for eligibility license for the disposal of waste and discarded electrical and electronic products, examination and approval of the said applications, and relevant supervisory and administrative activities.)
Measures for the Collection, Use and Administration of Funds for the Disposal of Discarded Electrical and Electronic Products
On 21 May 2012, the Ministry of Finance, the Ministry of Environmental Protection, the National Development and Reform Commission, the Ministry of Industry and Information Technology, the General Administration of Customs and the State Administration of Taxation jointly issued Measures for the Collection, Use and Administration of Funds for the Disposal of Discarded Electrical and Electronic Products, which stipulates that producers of electrical and electronic products, consignees of imported electrical and electronic products or their agents shall fulfill the obligation of paying the fund for the disposal of waste electrical and electronic products in accordance with the provisions.

Note: according to the Measures for the Collection, Use and Administration of Funds for the Disposal of Discarded Electrical and Electronic Products, the electronic and electrical products included in the collection scope of the fund shall be subject to the Catalogue of the Disposal of Waste Electrical and Electronic Products, and the collection standard shall be issued by the Ministry of Finance. Although a new version of the Catalogue was released in 2014, the Catalogue was only a product catalogue issued by the National Development and Reform Commission. The Ministry of Finance did not issue a new collection standard, so the disposal fund is only levied on the products included in the 2012 version of the Catalogue.
Applicable Standards and Criteria
Residues generated in the process of treatment and disposal, as well as sludge generated in the process of waste water treatment, shall be identified in accordance with the hazardous waste identification standard (GB 5085.1-3 Identification standards for hazardous wastes) for hazard characteristics.
Certification Procedures
An enterprise applying for the qualification for the disposal of waste electrical and electronic products shall submit a written application to the competent environmental protection department of the people's government of the city divided into districts where the disposal facilities of waste electrical and electronic products are located, and provide the relevant certification materials. Applicant enterprises should fill in the "Application for the Qualification of Disposal of Waste Electrical and Electronic Products" and submit the corresponding certification materials. If the applicant enterprise has more than one disposal facility for waste electrical and electronic products, it shall apply for the treatment qualification licence for each facility separately.
The competent environmental protection department of the municipal people's government shall, within 3 working days from the date of accepting the application, publicise the relevant information of the application and solicit public opinions. The publicity period shall not be less than 10 working days.
Enterprises with processing qualifications can apply for fund subsidies when processing the products of the Catalogue, and the subsidy standard is: 45 CNY per unit (for microcomputers)
