On May 1, 2022, China’s Administrative Measures on Cosmetics Labelling (hereinafter referred to as “the Measures”) officially came into force. The Measures were issued by the National Medical Products Administration (NMPA) on May 31, 2022. It contains 23 articles that aim at ensuring consumers/end-users with correct, clear and appropriate information delivered on cosmetics packages.

This document was drafted based on relevant laws and regulations such as the Administrative Measures on Cosmetics Supervision and Administration Regulations (CSAR), Product Quality Law of the People's Republic of China, Advertising Law of the People's Republic of China etc. The main contents of the document include:

·   Defining cosmetics labels; clarify responsibilities for registration/filing maker of cosmetics; stipulate cosmetic labelling principles.

·   Depicting detailed requirements on the label contents

·   Regulating the cases for flawed labels with corresponding applicable laws and regulations.

Labelling requirements have always been a key item in China’s cosmetics governance. Compliance teams of foreign stakeholders should act on compliance works to avoid potential risks. In the meantime, it is worth noting that the NMPA provides different measures to ensure a smooth transition for manufacturers with the new Measures. For products that were registered after May 1, 2022, the label must conform to the Measures; for those that applied for registration before the effective date, a one-year interim period is allowed for manufacturers to make necessary adjustments; for those that acquired the permit before its effective date, the interim period to make necessary adjustments is two years.
