AUG 11, 2021, “Implementation Outline for Building a Law-based Government (2021-2025)”

The Communist Party of China (CPC) Central Committee issued an outline urging local government agencies to continue advancing law-based government administration, and to build a law-based government in all aspects by 2025. It is listed as the Implementation Outline for Building a Law-based Government (2021-2025) (hereinafter referred to as the Outline) according to the current actual construction of law-based government.


In 2015, the CPC Central Committee issued the Implementation Outline for Building a Law-Based Government (2015-2020), and the new 2021-2025 Outline issued this year is a continued document of China's administrative system. This 10,000-word Outline is divided into ten parts, highlighting the need to “thoroughly study and implement Xi Jinping Thought on the Rule of Law”, “improve the law-based administration system”, and secondly requiring local governments to “improve the emergency response system and prevent and handle major emergency incidents in accordance with the law”.  The overall goal of the Outline is that by 2025, government actions will be fully integrated into the rule of law, the governance system with clear responsibilities and law-based administration will be increasingly improved, and the administrative law enforcement system and mechanism will be basically completed, constituting a solid foundation for basically establish a country, government and society under the rule of law by 2035.


The Outline puts forward a number of convenience measures such as comprehensively enhancing government services, improving systems of guaranteed satisfactory solution, one-time notification, one-window acceptance and self-service processing. By the end of 2021, frequently required “cross-provincial government services” will be basically achieved, and basic elderly care service needs will be fully guaranteed. At the same time, it is also emphasized to actively promote legislation in key areas including national security, technological innovation, public health, culture and education, ethnic religions, biological safety, ecological civilization, risk prevention, anti-monopoly, and foreign-related rule of law.


It should be noted that this document has repeatedly urged to strengthen the anti-monopoly law enforcement, consider legislation on national security and technological innovation. It also states that the government will play a greater role in regulating the development of industries such as Internet finance, artificial intelligence and cloud computing.


In terms of goal setting, the Outline clearly states to: “comprehensively build a law-based government with scientific functions, statutory rights and responsibilities, and strict law enforcement, which is open and impartial, operated efficiently, free from corruption and credible, and satisfied by people”. Compared with the 2015 Implementation Outline for Building a Law-Based Government (2015-2020), the 2021-2025 Outline further highlights the requirement for building a digital law-based government and improving people’s satisfaction. Building a digital government under the rule of law means that in the context of the digital age, advancing the process of reengineering the rule of law in institutions, functions, and processes, will help further eliminate phenomena of “isolated data island”, “algorithm abuse”, etc.
