Supervision Requirements Clarified for Children Toothpaste-MAY, 2022

On May 12, 2022, the China Oral Care Industry Association (COCIA) issued a statement on supervision for children’s toothpaste. It is based on an official response from the National Medical Products Administration (NMPA) after being consulted by the COCIA.

The statement raises the following concerns raised by COCIA:

·   Based on the newly implemented Cosmetics Supervision and Administration Regulations (CSAR), toothpaste is not included in the cosmetics category. It is defined as a product that should temporarily refer to management rules for general cosmetics , and shall comply with the “Toothpaste Supervision and Administration Regulations which will be issued and published in the future.

·   The fact that the “Toothpaste Supervision and Administration Regulations” is still under review under the State Administration for Market Regulation (SAMR).

·   Before the official publication and implementation of the “Toothpaste Supervision and Administration Regulations”, children’s toothpaste can continue regular sales in accordance with CSAR and the Provisions on the Supervision and Administration of Children's Cosmetics.    

The statement clears doubts for toothpaste manufacturers that are in the interim period when the toothpaste regulation is not in place yet. Meanwhile, foreign stakeholders are advised to follow-up on the updates of the “Toothpaste Supervision and Administration Regulations”, such as participating in the coming-up public opinion solicitation.
